CROWE & ROGAN LLP FIRM OVERVIEW

Specialists In Complex Litigation

Crowe & Rogan LLP specializes in representing corporations and high net worth individuals in a broad range of complex, multi-party litigation, including matters involving business and commercial transactions, product liability, environmental and toxic tort, airports and aviation, banking, credit cards, contracts, entertainment, joint ventures, partnerships, new technology, intellectual property, oil and gas, chemical industry, lemon law, professional liability, admiralty, maritime and real estate. Crowe & Rogan LLP also provides counseling to clients.

The success of Crowe & Rogan LLP rests in part on the practice of sophisticated corporate counsel who select skilled trial attorneys, rather than merely hiring large law firms to represent their corporations in litigation. Over 200 corporate counsel for the largest companies in the United States have selected our firm. With the “stamp of approval” of corporate counsel, our firm continues to grow and develop. Crowe & Rogan LLP is also listed in A.M. Best Company’s Directory of Recommended Insurance Attorneys.

Controlled Overhead And Lower Fees

Crowe & Rogan LLP was founded by experienced litigation attorneys who left their partnerships in national law firms to form our smaller, more focused firm of litigation specialists. We have more controlled overhead and lower fees.

Crowe & Rogan LLP offers increased value to our clients through enhanced use of state of the art technology, staffing that is leaner and relies more on experienced lawyers, reduced hourly rates and innovative fee structures that provide alternatives to the traditional hourly rate system.

Our leaner firm specializes in this market. The partners use their background of academic achievement and big firm experience to deliver more value to our clients.

Successful Trial Attorneys

Crowe & Rogan LLP sets itself apart by its track record of successful jury trial results in both Federal and State Courts. The partners of Crowe & Rogan LLP have tried to verdict over 160 complex cases with a success rate in the 90th percentile. In representing plaintiffs, we have obtained multi-million dollar jury verdicts and in representing defendants, we have consistently obtained defense verdicts.

Crowe & Rogan LLP built its reputation as trial attorneys by taking to jury trial in both Federal and State Courts on the average two multi-million dollar cases per year and obtaining consistent verdicts in our clients' favor. These cases have generally been appealed by our opponents and the jury verdicts in our clients' favor affirmed on appeal.

Crowe & Rogan LLP has been asked to take cases to trial that were prepared by other law firms. For example, the firm took over the defense of a complex fraud case involving an oil and gas joint venture just before trial when the lawsuit could not be settled. The firm successfully defended the case in a three month jury trial where plaintiffs sought $2 billion in damages.

Our trials involve numerous expert witnesses in areas as diverse as economics, accounting, securities, statistics, physics, engineering, metallurgy, international flight rules, aircraft and vehicle dynamics, accident reconstruction, biomechanics, waste disposal practices, chemistry, air and water monitoring, biology, toxicology, pathology, computers and high technology, marine architecture and engineering, cranes and rigging.

In substantial cases, the firm has tested opening statements on mock juries and adapted our presentation in light of their comments. We present a central theme to explain our clients' position supported by trial graphics. In jury interviews after the verdicts, we consistently find the jury understands the complex issues which we simplify for trial presentation.

Using Our Trial Experience To Negotiate Exceptional Settlements

Crowe & Rogan LLP’s success at trial provides leverage to resolve matters for clients in Alternative Dispute Resolution (ADR). Using our reputation as successful trial attorneys, we have settled hundreds of complex matters on favorable terms for our clients through Mediation and Arbitration. We are familiar with the Mediators and retired Judges associated with settlement firms such as JAMS, ADR Service, Judicate West and ARC.

For example, the firm obtained dismissal of a multi-million dollar lawsuit in exchange for a waiver of costs before taking the first deposition. In another matter, Crowe & Rogan LLP used ADR to successfully settle a $500 million claim against a multi-national corporation.

Joint Defense Counsel And Lead Liaison Counsel

Crowe & Rogan LLP has acted as Joint Defense Counsel and Lead Liaison Counsel. Due to our trial experience, Crowe & Rogan LLP was selected after a lengthy “beauty contest” as joint defense counsel to represent 140 of the largest industrial corporations in mass tort cases involving claims made by neighbors to an EPA Superfund site. Plaintiffs claimed damages in excess of $200 million for wrongful death, personal injury and diminution in property value. Plaintiffs were represented by the same attorneys who obtained more than $300 million from PG&E in the case made famous by the movie “Erin Brockovich.” Utilizing a highly developed strategy and specialized techniques, we settled the case through ADR for less than the cost of defense. Our clients tell us this is the best settlement they have ever seen in mass tort litigation.

Crowe & Rogan LLP acted as Lead Liaison Counsel to the Industrial Defendant Group in mass toxic tort cases involving claims that the entire San Gabriel Groundwater Basin was contaminated with industrial chemicals. Through use of our extensive trial experience, we successfully positioned the case in a highly defense oriented manner. This lead to the dismissal of the majority of the plaintiffs and settlements at less than the cost of defense.

National Counsel And Regional Counsel

Crowe & Rogan LLP acts as national litigation counsel and regional counsel for certain of its clients and has handled matters throughout the United States. The majority of matters have been in California, ranging from the greater Los Angeles area to San Diego, in the south, to San Francisco, Oakland and Eureka, in the north. The firm has also tried cases in other western states, including Washington and Nevada.

The firm has filed Briefs in the United States Supreme Court, the California Supreme Court, the Ninth Circuit and the Courts of Appeal.

Our Approach

The cornerstones upon which Crowe & Rogan LLP was founded and continues to use in its further growth and development are:

  1. Identifying the client's goals in the litigation and adopting a plan and a fee agreement consistent with those goals;
  2. Early analysis of the settlement value of the case and creation of a strategy to explore settlement possibilities, including the use of innovative settlement techniques and alternative dispute resolution;
  3. Identifying the key issues and creating a theme of the case which explains in simple direct terms why our client should prevail
  4. Efficient management of litigation through the use of budgets, a focus on the key issues and lower fees; and
  5. In cases that cannot be settled, preparing and presenting a case at trial that is victory-oriented and maximizes the chances of persuading the jury to find in our client's favor.

High Standards And Training Of Associates

The partners believe they can maintain the high standards of Crowe & Rogan LLP by working closely with each associate. Through this process, the associates receive training in all aspects of litigation from drafting pleadings to the trial of complex matters.

Crowe & Rogan LLP is committed to one-on-one training because the partners enjoyed the benefits of working closely with experienced and talented trial attorneys during the early years of their practice.
